The EquiCare mobile application is owned and operated by EquiCare App Pty Ltd (ACN 666 861 614). Our website is located at www.equicare.com.au. These terms apply to your use of the app and website.

By accessing or using the app, you agree to these terms. If you do not agree, please do not use the app.

The app is available for use on the condition that you accept these terms and our privacy policy, which outlines how we collect and handle your personal information.

We may update these terms from time to time. Any changes will be reflected in the app, and continuing to use it means you accept those changes.

Using this app is at your own risk, and our liability is limited in many circumstances. However, if you are a consumer, your rights under Australian Consumer Law are not limited by these terms.

We do not guarantee the app will be free of errors or interruptions. You are responsible for ensuring your own compliance with applicable laws when using the app.

You must not misuse the app. This includes attempting to hack it, breach security, contact other users inappropriately, impersonate others, or breach copyright. We may monitor usage and remove or restrict access if we suspect inappropriate behaviour.

To access the full functionality of the app, you will need to subscribe and create a user account. Subscriptions are managed through PayPal or the App Store, and fees are charged at the time of purchase. Subscriptions renew automatically unless cancelled before the next billing period.

You are responsible for your login details and all activity under your account. If your account is used without permission, or you suspect any security issue, contact us immediately.

We take your privacy seriously. By using the app, you consent to the way we collect and use your information as described in our privacy policy.

We may update or change features in the app without notice. We may also experience downtime or technical issues, and you acknowledge that we are not liable for any disruption, data loss, or errors that may occur.

The app is intended to support general horse management. It does not replace professional veterinary advice. Please consult qualified professionals before making changes to your horse’s care.

We are not liable for any loss you experience from using the app, except where that liability cannot be excluded under Australian law.

You must have the legal capacity to agree to these terms. You agree to compensate us for any loss we incur due to your breach of these terms or misuse of the app.

You can end these terms at any time by stopping use of the app and deleting your account. We can also end your access if we believe you’ve breached these terms.

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.

We may perform maintenance from time to time without notice. We may also assign our rights under these terms to another party if needed.

If any part of these terms is found to be invalid, the rest of the terms will still apply. Our rights under these terms do not lapse if we choose not to act immediately on a breach.

Using this app does not create any relationship of employment, partnership, or agency between you and us.

Definitions:

“Application Services” means any services provided via or in relation to the app.

“Consumer” means someone covered under Australian Consumer Law.

“Consumer Guarantees” are rights under the ACL that cannot be excluded.

“Content” includes all text, images, data and materials in the app.

“Intellectual Property” includes all copyright, trademarks, and other IP.

“Personal Information” is any info that identifies you.

“Privacy Policy” is available at www.equicare.com.au/privacy

“User Account” means your personal login for the app.

“User Content” means any content you submit or upload to the app.
